Terms of Service for ScentMax AI

1. Acceptance of Terms

By downloading, installing, or using ScentMax AI ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

ScentMax AI is a fragrance collection management and recommendation app that uses artificial intelligence to provide personalized suggestions. Features include:

• Fragrance collection tracking
• AI-powered recommendations (AI-Roma)
• Weather-based daily picks
• Scent Score analysis

3. Account Registration

• You must provide accurate information when creating an account
• You are responsible for maintaining account security
• You must be at least 13 years old to use the App
• One account per person; no shared accounts

4. Subscription Terms

Pricing

• ScentMax Pro Weekly: $0.99 per week (auto-renewing)
• ScentMax Pro Yearly: $39.99 per year (auto-renewing)

Billing

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

Cancellation

• You may cancel anytime through your Apple ID Account Settings
• No refunds for partial subscription periods
• Access continues until the end of the paid period

Free Trial

• If offered, any unused portion of a free trial is forfeited when you purchase a subscription

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer or hack the App
• Abuse the AI chat feature (spam, harassment, illegal content)
• Create multiple accounts to circumvent limits
• Share your account credentials
• Scrape or collect data from the App
• Impersonate others or misrepresent your identity

6. AI-Roma (AI Chat) Guidelines

• AI-Roma provides fragrance recommendations only
• Responses are AI-generated and may not always be accurate
• Do not rely on AI-Roma for medical, financial, or legal advice
• We reserve the right to limit or suspend access for abuse
• Daily usage limits apply (100 chats per day)

7. User Content

• You retain ownership of your fragrance collection data
• By using the App, you grant us a license to use your data to provide services
• You are responsible for the accuracy of data you submit
• We may use anonymized, aggregated data for analytics and improvement

8. Data Rights

By using ScentMax AI, you acknowledge that:

• Anonymized, aggregated data derived from your usage may be used commercially
• In the event of acquisition, your data transfers to the new owner
• You can delete your account and data at any time before any such event

9. Intellectual Property

• The App and its content are protected by copyright
• You may not copy, modify, or distribute App content without permission
• Fragrance names and brands belong to their respective owners
• Fragrance images are sourced from publicly available databases and belong to their respective owners; ScentMax AI does not claim ownership of these images

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

• We do not guarantee uninterrupted or error-free service
• AI recommendations are suggestions only, not professional advice
• Weather data is provided by third parties and may be inaccurate
• Fragrance data is for informational purposes only

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months
• We are not responsible for third-party services or content

12. Indemnification

You agree to indemnify and hold harmless SMStudios LLC and ScentMax AI from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Business Transfers

If ScentMax AI is involved in a merger, acquisition, or sale of assets, these Terms will continue to apply to your use of the App. The new owner will assume the rights and obligations under these Terms.

14. Termination

• You may delete your account at any time
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the App ceases immediately
• Provisions that should survive termination will remain in effect

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States. Any disputes shall be resolved in the courts of New Jersey.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ScentMax AI.
